COVID-19 Information ยป COVID-19 Court Operations

    • The U.S. District Court for the District of Hawaii continues to closely monitor the national, state, and local responses to the Coronavirus Disease (COVID-19) and is following guidance provided by the Administrative Office of the United States Courts (AO), the Centers for Disease Control and Prevention (CDC), and state and local health officials.  We will continue to post updates to general court operations to this webpage.

    • Beginning November 16, 2020, the courthouse will be open Monday through Friday (other than holidays), but solely for in-person court hearings or trials.  The public will be permitted to enter the courthouse on Mondays and Thursdays to attend in-person court hearings and for no other purpose. 

      • All persons entering the court house are REQUIRED TO WEAR A FACE MASK fully covering the nose and mouth while in all public areas of the court house.
      • The three exceptions to this rule are: 1) children too young to wear a face mask; 2) those who cannot wear a face mask due to medical necessity may wear a face shield in lieu of a face mask; and 3) individual judges may permit anyone speaking in a courtroom while court is in session to wear a face shield in lieu of a face mask, or permit a witness to testify behind plexiglass without a face mask or face shield.
      • Anyone seeking entry to the courthouse without a face mask will be provided a free face mask at the courthouse entry. Anyone refusing to wear a face mask (or face shield, if permitted) as required by this Order shall be denied entry, or removed from the courthouse, by the United States Marshals Service.
      • Hand sanitizer stations will be made available throughout the courthouse, including immediately upon entry and by all elevators. 
      • Everyone in the courthouse will be required to maintain social distancing of at least six feet, unless exempted by the Court. For instance, while at the entry pavilion or waiting for an elevator, all visitors are required to maintain at least a six-foot distance from the nearest person. The courtrooms will have chairs clearly designated for use that meet the six-foot distancing requirement.
      • Entry to the courthouse will be denied to anyone who has been diagnosed as having COVID-19 within the previous 14 days; anyone living with or in close proximity to anyone diagnosed as having COVID-19 within the previous 14 days; and anyone having symptoms of a COVID-19 infection, including fever, chills, shortness of breath, unexplained coughing, and new loss of taste or smell. 
      • Entry to the courthouse will be denied to anyone required by the State of Hawaii to be in self-quarantine.
      • Courthouse employees will be required to telework or be on approved leave for a 14-day period after entering the State of Hawaii from anywhere outside the State of Hawaii.
      • Any person entering the courthouse who has been outside of the State of Hawaii during a previous 14-day period is required to provide the Court with written notification that the person intends to enter the courthouse. Notification must be provided as early as possible. This notification requirement includes attorneys (appearing for any purpose) and witnesses, and applies regardless of any State of Hawaii exemption to a 14-day quarantine. Attorneys are responsible to provide notification on behalf of witnesses the attorney intends to bring into the courthouse. Notice must be provided as soon as feasible and sent to the orders email address for the presiding judge.     • The Clerk’s Office is closed to the public. Please refer to procedures for filing court documents below.

    • Filings will continue to be processed in civil and criminal cases via the CM/ECF electronic system and by mail. Rather than coming into the courthouse, paper filings must be deposited in the drop box located outside the courthouse or submitted by email.
        Filing By Mail
        Submit court filings via U.S. Postal mail to: United States District Court Clerk's Office, District of Hawai'i 300 Ala Moana Blvd. Rm C-338 Honolulu, HI 96850. Please include any additional copies for return. Remember to sign your original document and include the assigned case number. 
        Filing By Dropbox
        A secure drop box is located outside the entrance to the Prince Kuhio Federal Building and Federal Courthouse. The drop box is available for filing 24 hours a day 7 days a week. Please follow the instructions located on the drop box to file your document. Use the time clock to stamp and date your original document before placing it inside the secure drop box. Documents will be retrieved by court staff during normal business hours (8:30 a.m. to 4:00 p.m.) each regular business day (Monday through Friday, excluding holidays). Documents will be filed stamped for the date and time that they were placed inside the drop box and returned to the filer via U.S. Mail. Please provide additional copies for return. 
        Filing By Email
        Pro se litigants may now submit filings by email to: File-stamped copies will be returned by email. 
      All documents submitted by email must include:
      1. The filer's name, address and telephone number in the top left side corner of the first page of the main document; and
      2. The signature of the filing party either in electronic format ex. (s/ John Doe) or, signed by hand and scanned to pdf.
      Documents for filing must be attached to the email as a separate pdf.

        Sealed Submissions
        All local rules regarding sealed documents remain in effect. Upon filing a Motion to Seal on the public record, the movant must email the following documents to the judge for review: 1) a copy of the filed motion to seal, 2.) a proposed order to seal and, 3.) a copy of each document that the party seeks to file under seal. Please make sure that your email submission is accurate and includes all necessary attachments prior to sending. If the order to seal is granted the document will be filed in CM/ECF and a filed copy of the sealed document will be emailed to the filing party. 

    • Beginning on March 15, 2021, parties are again required to provide mandatory chambers copies as required by Local Rule 10.3. Mandatory Chambers Copies may be mailed as permitted by Local Rule 10.3(c)(2)

    • The Clerk's Office will accept payments by money order, cashier check, and personal check via the drop box or by mail. DO NOT PLACE CASH IN THE DROPBOX. Cash payments will NOT be accepted during this period of exigent circumstances.  

    • The court authorizes up to two grand jury sessions to be held per month through March 2021.
      No jury trial shall commence prior to November 16, 2020.
      Once the court reopens to trials, multiple trials cannot safely be conducted simultaneously; only one trial can be safely held at a time.

    • Each presiding district or magistrate judge will determine whether civil matters, including case management matters, settlement conferences, and hearings, will be taken off calendar pursuant to Local Rule 7.1, or conducted by telephone, video conference, or in court.

      Each presiding judge will determine how to proceed with civil non-jury trials.

      Criminal Proceedings

      At the discretion of the presiding judge, the Court will continue to conduct certain criminal proceedings by telephone or video as permitted by the Court’s most current CARES Act Order.

      Certain criminal proceedings that fall outside the Court’s most recent CARES Act Order will be conducted in court, if possible.

      Public and Media Access to Court Proceedings By Telephone or Video Conference

      If a presiding judge elects to proceed with a hearing by telephone or video conference, all hearings will be available to members of the public and the media, to the extent practicable. Specific information will be available on each case’s individual docket on PACER, and further instructions can be found here. Members of the public and media are strictly prohibited from recording or broadcasting any hearing (whether telephonic or video conference), in whole or in part, in any fashion. Failure to abide by this restriction may result in sanctions. 

    • Public court documents can be obtained through PACER.GOV.  If you need assistance with court documents and are unable to access or, cannot afford to use PACER.GOV, please call 541-1890 for assistance.  The Federal Records Centers Program is gradually resuming operations on a records center by records center basis based on local conditions and specific safety criteria.     • The Central Violations Bureau (CVB) is a national center responsible for processing violation notices (traffic tickets) and fine payments for petty offenses issued on federal properties ONLY. In the State of Hawaii this includes: Schofield Barracks, Fort Shafter, Tripler Army Medical Center, Joint Base Pearl Harbor, Hickam Air Force Base, Marine Corps Base Hawaii, Haleakala National Park (Maui), and Volcanoes National Park (Hawaii Island).

      COURT HEARINGS: If you do not pay your ticket, you will receive a Notice to Appear, usually within 4 to 8 weeks from the date of issuance. The notice will be mailed to the address listed on the ticket. If you need to update your address, see instructions below. If you pay before your scheduled court date you do not need to appear in court. To check on the status of your ticket call 1-800-273-3658.

      MANDATORY APPEARANCESAll court appearances will be held by telephone.
      If your ticket is marked mandatory appearance, you must call the number below on the scheduled date and time to appear.
