PROPOSED AMENDMENTS TO THE LOCAL RULES OF PRACTICE FOR
THE UNITED STATES DISTRICT COURT FOR THE DISTRICT OF HAWAII

In early October 2009, the United States District Court for the District of Hawaii posted proposed amendments to the Local Rules of Practice for the United States District Court for the District of Hawaii. The proposed amended rules were available for public viewing and review on this court’s website, www.hid.uscourts.gov and in the Office of the Clerk of Court for the United States District Court for the District of Hawaii. The public was allowed to submit comments about the proposed amendments and that comment period on the earlier proposal is now closed.

Based on comments received from the public and from court employees, the United States District Court for the District of Hawaii, acting through a majority of its district judges, pursuant to Rule 83 of the Federal Rules of Civil Procedure, now proposes further amendments to the proposed Local Rules of Practice for the United States District Court for the District of Hawaii previously issued for public comment. These further proposed amended rules are available for public viewing and review on this court’s website, www.hid.uscourts.gov, and in the Office of the Clerk of Court for the United States District Court for the District of Hawaii. Given how few the further amendments are in number, the courts asks for comments within a relatively short time. The public may submit comments about these latest proposed amendments to the local rules via an email with a subject line stating “Comments on Proposed Amendments to Local Rules” to hid_general@hid.uscourts.gov through and including November 9, 2009. Comments may alternatively be mailed to the Honorable Susan Oki Mollway, Chief Judge, United States District Court for the District of Hawaii, 300 Ala Moana Blvd., C-409, Honolulu, HI 96850. Mailed comments should reach the courthouse by November 9, 2009.

Also made available for public comment in the same manner and by the same deadline is a proposed Order Amended the Criminal Local Rules of Practice for the United States District Court for the District of Hawaii. This order addresses changes to the criminal local rules only to the extent required for consistency with the Federal Rules of Criminal Procedure, which will be amended effective December 1, 2009. Additional proposed amendments to the criminal local rules that are not required by amendments to the Federal Rules of Criminal Procedure will be posted for public comment in due course, but are not presently proposed.
